Digital Services Act, DSA

According to Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on the Digital Single Market and amending Directive 2000/31/EC (Digital Services Act) – “DSA”, insofar as IFIRMA SA, with its registered office in Wrocław, at 241G Grabiszyńska Street (“IFIRMA,” “Service Provider,” “we,” “us,” “our”), the owner of Firmbee.com, offers intermediary services on this website within the meaning of Article 3(g) of the Regulation, the following information applies:

CONTACT POINT FOR COMMUNICATION REGARDING DSA (Articles 11 and 12 of the DSA)

The single contact point for the Member States’ authorities, the Commission, and the Council, as referred to in Article 61 of the DSA, as well as for recipients/users of services provided by IFIRMA SA, is the email address [email protected].

Communication is handled in Polish or English.

REPORTING ILLEGAL CONTENT (Article 16 of the DSA)

According to Article 16 of the DSA, individuals and entities have the possibility to report content on IFIRMA SA websites that they consider illegal. To make such a report, the following information must be provided:

a) a sufficiently detailed explanation of the reasons why the person or entity claims that the information in question constitutes illegal content,

b) a clear indication of the exact electronic location of the information, such as the exact URL or URLs, and, if applicable, additional information to identify illegal content, depending on the type of content and the specific type of hosting service,

c) the name and surname or name and e-mail address of the person or entity making the report, except for a report on information that is considered to be related to one of the crimes referred to in Articles 3-7 of Directive 2011/93/EU,

d) a statement that the person or entity making the report believes in good faith that the information and allegations contained in the report are accurate and complete.

Such a report is considered to provide the basis for actual knowledge or information within the meaning of Article 6 of the DSA, with respect to the information to which it relates, as it enables the Service Provider, acting with due diligence, to determine – without detailed analysis – the illegal nature of the activity or information in question.

If the report includes electronic contact information of the person or entity making the report, the Service Provider will promptly notify them of its decision regarding the information to which the report relates and provide information on how to appeal the decision.

REPORTING OBLIGATIONS (Article 15 of the DSA)

Under Article 15(1) of the DSA, we are required to publish annual reports on the content moderation we have undertaken during the period. Such reports will be published by IFIRMA at a specified time at ifirma.pl/DSA.
